Tougher state and county laws are needed
Land use laws in Hawaii are clear but difficult to enforce by the counties.
Hawaii county, with large rural and agricultural areas, will need statutes specific to recreational off road vehicles. Some examples:
Ex 1: Operation of recreational off-highway or off-road vehicles (ORV, OHV), including all terrain vehicles (ATVs), motorcycles, or similar vehicles shall not be conducted in a manner in which sound from such operation may be heard beyond the boundaries of the subject property without a special permit. Utility off road vehicles used for transport of persons and materials or for tending livestock are exempt.
Ex 2: Motorized recreational off -road vehicles may not be operated on any public or private property not specifically designated for such use.
